§ 1 Scope of Application and Customer Information
The following General Terms and Conditions (GTC) govern the contractual relationship between Torro GmbH (Torro Shop) and consumers and business customers purchasing goods through our online shop.
Any terms and conditions of the customer that conflict with or deviate from these General Terms and Conditions shall not be recognized unless expressly agreed to by us in writing.
The language of the contract shall be German.
(1) The products and services presented in our online shop constitute a binding offer to enter into a purchase agreement.
(2) You may place one or more products in your shopping cart. During the ordering process, you will be asked to provide your personal information and specify your preferred payment method, delivery options, and other relevant details. The purchase agreement is concluded when you accept our offer by clicking the order button and submitting your order.
Alternatively, a purchase agreement may also be concluded by telephone.
(1) You may place products in your shopping cart without obligation by clicking the "Add to Cart" button.
(2) You can view all items placed in your shopping cart at any time by clicking "View Cart". There, you may also remove items or change quantities.
(3) If you wish to purchase the items in your shopping cart, click "Proceed to Checkout". This will take you to the ordering process.
(4) During the ordering process, you will be asked to provide your delivery and payment information.
(5) Before submitting your order, you will be presented with an order summary containing all details of your intended purchase, including your billing and delivery addresses, products selected, prices, quantities, payment method, and shipping method. At this stage, you have the opportunity to review your information, identify any input errors, and correct your order details if necessary.
(6) By clicking the button labeled "Place Order with Obligation to Pay" (or equivalent wording), you submit your order to us.
(7) You will receive an order confirmation by email. This confirmation constitutes our legally binding acceptance of your order.
We reserve the right to accept or reject orders, in whole or in part, particularly in cases where the products ordered are unavailable or only available in limited quantities.
Subject to product availability, delivery shall be made within 2 to 4 business days.
The delivery period shall commence:
- In the case of advance payment (bank transfer), on the day following receipt of payment;
- In the case of payment via PayPal, credit card, easyCredit installment purchase, cash on delivery, or purchase on account, on the day following the conclusion of the contract.
If the last day of the delivery period falls on a Saturday, Sunday, or a public holiday officially recognized at the place of delivery, the delivery period shall expire on the next business day.
§ 3 Customer Information: Storage of Order Data
We store your order and the details of the contract concluded with you (e.g., type of product, price, and other order-related information).
We will provide you with a copy of these Terms and Conditions. In addition, you may access the current version of the Terms and Conditions on our website at any time after the conclusion of the contract.
If you have registered a customer account, you may access and review your previous orders through the customer login area ("My Account").
§ 4 Customer Information: Correction of Input Errors
You may correct your entries at any time before submitting your order by using the delete, backspace, or other editing functions available in your browser or on the website.
Throughout the ordering process, we will provide information on additional options for reviewing and correcting your entries.
You may also terminate the ordering process at any time by closing your browser window before submitting your order.
§ 5 Customer Information: Code of Conduct

The goods shall remain our property until full payment of the purchase price has been received.
The statutory rights relating to defects in goods (warranty rights) shall apply.
We shall not be liable for breaches of duty caused by slight negligence, unless such breaches concern essential contractual obligations, result in injury to life, body, or health, relate to guarantees, or give rise to claims under applicable product liability laws.
The same limitation of liability shall apply to breaches of duty by our agents, employees, representatives, and other persons engaged in the performance of our obligations.
Essential contractual obligations are those obligations whose fulfillment is necessary for the proper performance of the contract and upon whose observance the customer may regularly rely. In particular, such obligations include the duty to deliver the goods to you and to transfer ownership thereof, as well as the duty to provide the goods free from material defects and defects in title.
§ 9 Governing Law, Jurisdiction and Final Provisions
All deliveries and services are provided exclusively on the basis of these Terms and Conditions. The laws of the Federal Republic of Germany shall apply exclusively, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If the customer is a merchant (Kaufmann), a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising out of or in connection with the contractual relationship shall be Aschaffenburg, Germany. For the purposes of these Terms and Conditions, a "merchant" (Kaufmann) is any person or entity operating a commercial business or otherwise classified as a merchant under the provisions of the German Commercial Code (Handelsgesetzbuch – HGB). A "consumer" is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or self-employed professional activity.

Consumers are entitled to a legal right of withdrawal. A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to his or her commercial or self-employed professional activity (§ 13 BGB).
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period shall be fourteen days from the day on which you, or a third party designated by you who is not the carrier, takes possession of the goods.
To exercise your right of withdrawal, you must inform us (Torro GmbH, Am Röhrig 2, 63762 Großostheim, service@torro.de, Phone: +49 (0) 60269988599) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax, or e-mail).
You may use the attached model withdrawal form for this purpose, but this is not mandatory. You may also exercise your right of withdrawal online at https://www.torro-shop.de/Online-cancellation-form
If you make use of this online option, we will promptly provide you with an acknowledgement of receipt of your withdrawal on a durable medium (e.g. by e-mail), including information regarding the content of the withdrawal declaration as well as the date and time of receipt.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of any supplementary costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract.
We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back, or until you have supplied evidence of having sent back the goods, whichever is the earlier.
You shall send back the goods or hand them over without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us at:

The deadline is met if you send back the goods before the period of fourteen days has expired.
You will bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer.
